These Terms & Conditions ("Terms") apply to your use of the website at towingnewmarket.ca (the "Website") and to any request for service you make through the Website, by phone, or by any other means that references Newmarket Towing. By using the Website or requesting service, you agree to these Terms. If you do not agree, please do not use the Website.

1. About Newmarket Towing

Newmarket Towing operates this Website to connect people who need towing or roadside assistance in Newmarket, Ontario and the surrounding areas with a towing company. When you call the phone number on this Website or submit a request through it, your request is referred to ASAP Towing Services Inc. (the "Service Provider").

The Service Provider is an independent business. It is not an employee, agent or franchise of Newmarket Towing. The Service Provider sets its own prices, dispatches its own vehicles and operators, and performs all work. Any agreement for towing or roadside assistance is made directly between you and the Service Provider.

Descriptions on this Website written in the first person (for example "we", "our team", "our fleet" or "our operators") describe the services available through our referral partner and do not mean that Newmarket Towing itself performs those services.

2. Quotes, Pricing and Payment

Any quote you receive is provided by or on behalf of the Service Provider and is based on the information you give, including your location, destination, vehicle type and the service needed. Final pricing may change if the actual circumstances differ from what was described. Payment for services is made to the Service Provider, under the Service Provider's terms.

3. Response Times and Availability

Estimated arrival times are estimates only. Response times depend on traffic, weather, road conditions, call volume and other factors outside our control. We do not guarantee that a service will be available at any particular time or location.

4. Your Responsibilities

You agree to provide accurate information about your location, vehicle and situation; to remain in a safe location while waiting for help; and to make sure you are legally entitled to have the vehicle serviced or moved. In an emergency involving injury or danger, call 911 first.

5. Limitation of Liability

To the fullest extent permitted by applicable law:

• Newmarket Towing acts only as a referral service and is not responsible for the towing or roadside assistance performed by ASAP Towing Services Inc. or its operators, including the quality, timing, pricing or outcome of that work.
• ASAP Towing Services Inc. is solely responsible for all services it performs and for any loss of or damage to vehicles, property or personal belongings, and for any injury, that arises from those services. Any claim relating to the services must be made against ASAP Towing Services Inc..
• Newmarket Towing is not liable for any direct, indirect, incidental, special or consequential damages arising from your use of the Website or from services provided by the Service Provider.

Nothing in these Terms limits any rights you have under Ontario consumer protection legislation or other laws that cannot be excluded by agreement.

6. Website Information

We try to keep the information on this Website accurate and up to date, but it is provided "as is" without warranties of any kind. Service descriptions, images and availability may change without notice.

7. Information You Send Us

When you contact us by phone or through the contact form, we collect the information you provide, such as your name, phone number, email address, location and details about your vehicle and request. We use this information to respond to you and to refer your request to ASAP Towing Services Inc., which will use it to contact you and provide the service. We do not sell your personal information.

8. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when they were last changed. Continuing to use the Website after changes are posted means you accept the updated Terms.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
